MINNESOTA HOMESCHOOL STATUTE SUMMARY
Minn. Stat. Ann.ยง 120A.22.

Compulsory Attendance Ages: "between 7 and 16 years of age."

Required Days of Instruction: None.

Required Subjects:
1. Basic communication skills including reading, writing, literature and fine arts.
2. Mathematics and Science
3. Social studies including history, geography and government
4. Health and physical education

The home instructor must satisfy one of the following six requirements:
1. Hold a Minnesota teaching license in the field and grade taught, or
2. Be directly supervised by a person licensed to teach in Minnesota, or
3. Successfully complete a teacher competency exam, or
4. Instruction is provided in a school that is accredited or recognized by the state board, or
5. Hold a baccalaureate degree, or
6. Be the parent of a child who is assessed quarterly in the required subjects above.

The parent-instructor must report to the local superintendent the name, age, and address of each child taught by Oct. 1 of each school year. The report must include the name of the instructor and evidence of meeting the requirement. Proof of immunization or proof of exemption from immunization must be supplied.

On-Site Visits: A superintendent or the superintendent's designee may make an annual on-site visit to the home where the child is receiving instruction to determine if the school is in compliance with the law. In lieu of this visit, however, a parent who is providing instruction at home may present, outside of the home, the documentation, including class schedules, copies of materials used for instruction and description of method used to assess student achievement indicating that the subjects required are being taught.

Standardized Tests: Children not enrolled in public school must be assessed using a nationally norm-referenced standardized achievement examination. Parent and district superintendent must agree on the test, administration, and location of the test. Parents who do not meet teacher requirements 1-3 must assess their children in subject areas not covered by the test. Children who score below the thirtieth percentile, or one full grade below children of the same age, must be evaluated for learning problems.
